In New Jersey, the law sets the floor. Know it first.
Week per year, mandated
Covered NJ layoffs come with statutory severance — generally one week of pay per full year of service — owed whether or not you sign a release. A release should only buy pay above that floor.
Days' NJ notice
New Jersey requires 90 days' advance notice for covered mass layoffs — half again longer than federal law. A shortfall adds up to four more weeks of pay on top of severance.
Days to consider
Group layoffs give workers 40+ a 45-day OWBPA review window before signing a release, plus 7 days to revoke after. Repeat rounds invite close scrutiny of the required disclosures.
Day aggregation rule
Separations within a 90-day window can aggregate into one covered event — so a smaller filing may carry the same protections as the biggest one in the wave.
